What if my attorney says the title is clear, but the title company disagrees?

If your attorney believes the title is clear but the title company finds outstanding issues, we must follow the title company’s determination.

This is because the title company is providing the title insurance required for closing, and they must meet strict underwriting standards. Any liens, judgments, recording errors, or ownership issues they identify need to be resolved before your Home Equity Investment can move forward.

You’re welcome to share your attorney’s documentation with the title company for review. However, closing can’t proceed until the title company confirms the issue has been cleared.
